Employee brought retaliatory discharge action against employer. The United States District Court for the Central District of Illinois, Michael M. Mihm, J., entered judgment for employee pursuant to jury verdict and denied employer’s motion for judgment notwithstanding the verdict. Employer appealed. The Court of Appeals, Swygert, Senior Circuit Judge, held that employee failed to set forth sufficient facts in which jury could reasonably infer that motive for discharge was to deter employee from exercising worker’s compensation rights.
